Increasingly, medical records are being stored in computer databases that allow for efficiencies in providing treatment and in the processing of clinical and financial services. Computerization of medical records has also diminished patient privacy and, in particular, has increased the potential for misuse, especially in the form of nonconsensual secondary use of personally identifiable records. Organizations that store and use medical records have had to establish security measures, prompted partially by an inconsistent patchwork of legal standards that vary from state (...) to state. There is widespread appreciation among policy makers regarding the need for legal reform. The Health Information and Portability Accountability Act of 1996 mandated that the Administration develop regulations regarding the control of medical records. The Administration has offered regulations from the Department of Health and Human Services. Survey data reveal what healthcare professionals who have access to sensitive medical records believe are the greatest threats to patients' privacy. The overlap between Administration proposals and the responses of healthcare professionals is striking. (shrink)

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. In 2009, Greenpeace launched an aggressive campaign against Nestlé, accusing the organization of driving rainforest deforestation through its palm oil suppliers. The objective was to damage the brand image of Nestlé and, thereby, force the organization to make its supply chain more sustainable. Prominent cases such as these have led to the prevailing view that sustainable supply chain management is primarily reactive and propelled by external pressures. This research, in contrast, assumes that SSCM can contribute positively to the reputation of (...) an organization as a “good citizen” and, thereby, counter the impression that external stakeholder pressure is the only driver of SSCM. The study draws on Resource Dependence Theory in analyzing the three competing models of the potential stakeholder, SSCM and the corporate sustainability performance relationship. A dataset of 1,621 organizations allows the statistical comparison of these three models. Findings suggest that stakeholder pressure and SSCM both contribute to an organization’s sustainability performance. Thus, supply chain managers will perceive benefits from SSCM other than merely the reduction of risk from reputational damage through stakeholder activism. (shrink)

Such critics "do not believe in Freud" in much the same way as atheists "do not believe (...) in God," and their rejections of psychoanalysis in the name of the secular partake in the very structure of religious thought they claim to repudiate. In Seminar XXI: Les non-dupes errent, Lacan comments on the blindness of the atheistic insight concerning religion: "I know that you're not believers, right? But that doesn't mean that you aren't all the more conned... because even if you are not believers, you still believe in that aspiration [for the love of God]. I won't say that you suppose it; rather, it supposes you" [Dec. 18, 1973; our trans.]. People disagree frequently, about both objective and subjective matters. But while at least one party must be wrong in a disagreement about objective matters, it seems that both parties can be right when it comes to subjective ones: it seems that there can be faultless disagreements. But how is this possible? How can people disagree with one another if they are both right? And why should they? In recent years, a number of philosophers and linguists have argued that we must (...) become relativists about truth to understand faultless disagreements. This book shows that we can dispense with relativism. It combines a more standard semantics with a novel pragmatic theory to develop a superior approach. The book discusses both classic and recent literature in philosophy and linguistics. There is long standing agreement both among philosophers and linguists that the term ‘counterfactual conditional’ is misleading if not a misnomer. Speakers of both non-past subjunctive (or ‘would’) conditionals and past subjunctive (or ‘would have’) conditionals need not convey counterfactuality. The relationship between the conditionals in question and the counterfactuality of their antecedents is thus not one of presupposing. It is one of conversationally implicating. This paper provides a thorough examination of the arguments against the presupposition view as applied to (...) past subjunctive conditionals and finds none of them conclusive. All the relevant linguistic data, it is shown, are compatible with the assumption that past subjunctive conditionals presuppose the falsity of their antecedents. This finding is not only interesting on its own. It is of vital importance both to whether we should consider antecedent counterfactuality to be part of the conventional meaning of the conditionals in question and to whether there is a deep difference between indicative and subjective conditionals. ABSTRACT Drawing upon a distinction between epistemically and metaphysically motivated notions of a concept, I consider the insurmountable problems of theories that appeal to our epistemic capacities to address the problem of the nature of concepts satisfactorily. Prominent theories of concepts hold that primitive concepts must have internal structure if they are to account for the explanatory functions that cognitive scientists have attributed to such constructs as prototypes, exemplars, and theories. Vindicating the role of non-experimental philosophy in the critical examination (...) of empirical theories, I argue that the explanatory effectiveness of those constructs is orthogonal to an argument concerning the structure of primitive concepts. Conceptual atomism provides an alternative approach to individuating primitive concepts the precise formulation of which has yet to be worked out. Despite its unpopularity, the atomist alternative is still in a better position to face the question of what concepts are than its competitors. RESUMEN Haciendo una distinción entre nociones de concepto epistémica y metafísicamente motivadas, considero las dificultades insuperables que enfrentan las teorías que apelan a nuestras capacidades epistémicas para abordar el problema de la naturaleza de los conceptos. Las teorías de conceptos más importantes sostienen que los conceptos primitivos deben poseer una estructura interna para cumplir aquellas funciones explicativas que científicas y científicos cognitivos les han atribuido a constructos tales como prototipos, ejemplares y teorías. One of the deepest and longest-lasting debates in ethics concerns a version of the Euthyphro question: are choiceworthy things choiceworthy because agents have certain attitudes toward them or are they choiceworthy independent of any agents’ attitudes? Reasons internalists, such as Bernard Williams, Michael Smith, Mark Schroeder, Sharon Street, Kate Manne, Julia Markovits, and David Sobel answer in the first way. They think that all of an agent’s normative reasons for action are grounded in facts about that agent’s pro-attitudes (e.g., (...) her desires, valuing states, normative judgments). According to the most popular brand of internalism, idealizing internalism, an agent’s reasons are grounded, not in her actual pro-attitudes, but rather in what her pro-attitudes would be in suitably idealized conditions. Idealizing internalists presuppose that, for any agent with an irrational set of attitudes, there is one uniquely rational set that that agent would have if she were to undergo the relevant idealizing process. I argue that this assumption is false and that it raises two puzzles for idealizing internalism: one about the existence of practical reasons and another about their normative weight. I argue that idealizing internalists have an adequate solution to the first puzzle but not the second. Indeed, when they try to solve the second puzzle, they confront a dilemma. This second puzzle and the associated dilemma thus constitutes a powerful, but so far unnoticed, difficulty for idealizing internalism. (shrink)

I am referring to the interdisciplinary research group Histopia, which has its base in Madrid́s Autónoma (...) University, is comprised of twenty-seven researchers from different institutions, and is coordinated by historian Juan Pro. As the name Histopia suggests, it was founded by historians. From the beginning there have been people from other fields, such as political science, architecture, cultural studies, and art history. The aim was always understanding utopianism beyond the study of texts, and centering research in everything that utopianism produces, such as social movements, political programs, and urban programs. In this sense, a premise was to understand utopias not as a footnote in history or a series of eccentric events, but as a guiding force that drives a [End Page 510] history. This placing of utopianism in history was clearly announced in the grouṕs website:Histopia seeks to go beyond the philological approach that predominates in Utopian Studies and to historicize the study of contemporary utopias and dystopias, showing how they respond to the contexts in which they arise, since they reflect the problems and frustrations of a society as well as the aspirations for change it contains, and the conditions of possibility that a particular cultural and emotional framework offers for developing them.1Together with this focus on history, which departs from the more text-centered traditions of an important part of utopian studies, the other main particularity of Histopia is its decentralizing of utopian studies towards the Spanish-speaking world. And to this end, the group also founded the Transatlantic Network for the Study of Utopias, which was created in 2015 to put in communication over 250 researchers, most of them from Latin America, but also from other places such as Australia or Japan.2The Spanish statés research funding programs have provided the bureaucratic framework and the material resources for the research group since 2015. Together with seminars, conferences, or workshops, the resulting publications have been linked with utopian literature, with dystopia, and with a focus on viewing history through the lens of utopia. One of the most recent endeavors has been a radically collective one, articulating a Dictionary of Utopian Places written by a multitude of authors.3 Histopia has also initiated several projects with schools, for the most part ongoing, and there have been many attempts to disseminate its work through radio and video projects. And since its founding, Histopia has tried reaching out beyond the Academy—an effort that is finally gaining success. In 2021 the international conference Intentional Communities: Concrete Utopias in History was extremely fruitful: we saw involved participation both in various interventions, and through activities such as streaming. Participants included people and organizations from social movements and from intentional communities.I want to argue here that the very formation of Histopia was a logical development from certain political triggers—and in particular, the so-called 15M Movement, a series of anti-austerity protests and direct-democracy initiatives that ignited antigovernment activism throughout Spain from 2011 on, culminating in the occupation of urban spaces (“encampments”) and in very large political assemblies. Mental health issues are on the rise among early career researchers (ECRs), endangering the future of academia. Horizontal linkages among ECRs can play a role in building a reliable emotional support system. We offer four suggestions to overcome existing barriers and foster these linkages.

This joint response to the roundtable takes the form of a written dialogue, based on longer conversations via video link and instant messaging. The written dialogue seems an especially apt format for this response, so interconnected is it with the traditions of utopian thinking from Plato onward, and one which moreover has much to do with utopian heuristics.

Centuries before being included in Hugo Grotius’s De iure belli ac pacis and De iure praedae, the subject of reprisal was already being discussed in medieval literature. The aim of this paper is to examine the medieval and early modern practice and theory of reprisal as it developed before and during Grotius’s lifetime. Its first part investigates a number of important foundational elements, such as the issues of definition and terminology, and the common characteristics of a reprisal case. In the (...) second half, the author explores why reprisals were deemed to be a ‘perversus mos’ or ‘bad custom’ and how continued reliance on this practice was nonetheless justified by inserting it into the medieval just war doctrine. The paper does not provide a systematic study of Grotius’s own engagement with medieval reprisal sources. Rather, it should be read in conjunction with another publication in this same volume, ‘Grotius on Reprisal’ by Randall Lesaffer. (shrink)

National legislation, as well as arguments of experts, in Germany and Israel represent opposite regulatory approaches and positions in bioethical debates concerning end-of-life care. This study analyzes how these positions are mirrored in the attitudes of laypeople and influenced by the religious views and personal experiences of those affected. We qualitatively analyzed eight focus groups in Germany and Israel in which laypeople were asked to discuss similar scenarios involving the withholding or withdrawing of treatment, physician-assisted suicide, and euthanasia. In both (...) countries, respect for patient autonomy and patients’ wishes to die with dignity found broad consent. Laypeople argued in favor of accepting such wishes when they were put down in an advance directive. Laypeople in non-religious groups in both countries argued on the basis of a respect for autonomy for the possibility of euthanasia in severe cases but, at the same time, cautioned against its possible misuse. National contrast was apparent in the moral reasoning of lay respondents concerning the distinction between withholding and withdrawing treatment. The modern religious laypeople in Israel, especially, argued strongly, on the basis of the halakhic tradition, against allowing the withdrawal of treatment in accord with a patient’s wish. We conclude by discussing the emergent notion of shared responsibility and views of professional responsibility, which we connect through relevant cultural themes such as religion and national culture. Surrealism in North Africa and Western Asia : crossings and encounters -- Multiple surrealisms -- Surrealist encounters.

Managers tasked with organizational change often face irreconcilable demands on how to enact justice—situations we call _justice conundrums_. Drawing on interviews held with managers before and after a planned large-scale change, we identify specific conundrums and illustrate how managers grapple with these through three prototypical paths. Among our participants, the paths increasingly diverged over time, culminating in distinct career decisions. Based on our findings, we develop an integrative process model that illustrates how managers grapple with justice conundrums. Our contributions are (...) threefold. First, we elucidate three types of justice conundrums that managers may encounter when enacting justice in the context of planned organizational change (the justice intention-action gap, competing justice expectations, and the justice of care vs. managerial-strategic justice) and show how managers handle them differently. Second, drawing on the motivated cognition and moral disengagement literature, we illustrate how cognitive mechanisms coalesce to allow managers to soothe their moral (self-) concerns when grappling with these conundrums. Third, we show how motivated justice intentions ensuing from specific justice motives, moral emotions, and circles of moral regard predict the types of justice conundrums managers face and the paths they take to grapple with them. In this paper 1 argue that it would be unprincipled to withhold mental predicates from our behavioural duplicates however unlike us they are “on the inside.” My arguments are unusual insofar as they rely neither on an implicit commitment to logical behaviourism in any of its various forms nor to a verificationist theory of meaning. Nor do they depend upon prior metaphysical commitments or to philosophical “intuitions”. Rather, in assembling reminders about how the application of our consciousness and propositional attitude (...) concepts are ordinarily defended, 1 argue on explanatory and moral grounds that they cannot be legitimately withheld from creatures who behave, and who would continue to behave, like us. I urge that we should therefore reject the invitation to revise the application of these concepts in the ways that would be required by recent proposals in the philosophy of mind. (shrink)

We survive a period of relentless stress, perhaps because we are in a war zone and witness or commit atrocities. Raised by parents who are alcoholic or mentally ill, we endure traumatic experiences on a daily basis. Or, we are ignored, neglected, or treated as playthings by narcissistic parents, who themselves were ignored and neglected, and on and on through generations. In this paper, I draw from Kantian and Husserlian reflections on the self-awareness of thinking for a contribution to the cognitive phenomenology debate. In particular, I draw from Kant’s conceptions of inner sense and apperception, and from Husserl’s notions of lived experience and self-awareness for an inquiry into the nature of our awareness of our own cognitive activity. With particular consideration of activities of attention, I develop what I take to be Kant’s and Husserl’s “agentive” and “proprietary” accounts. These, I (...) believe, augment contemporary discussions in interesting ways and further bolster the case for cognitive phenomenology. Moreover, the historical comparison highlights a number of assumptions made today that were not yet part of the framework at the time of Kant or at the time of Husserl. Approaching Simone de Beauvoir's feminism and social commentary as a toolkit to understand our current crises, Simone de Beauvoir: Toolkit for the 21st Century brings together established and emerging scholars to apply her insights to gender studies, political philosophy, decolonisation, intellectual history, age theory, and critical phenomenology. The essays in this collection start from key concepts in Beauvoir's oeuvre and relate them to contemporary debates, asking how her notion of ambiguity speaks to decolonial freedom struggles; how myths inform our notions (...) of collective, national identities; how masculinity and its violence has reached new levels with the emergence of 'Incels'. These and other issues are central to this critical appraisal of Beauvoir's legacy, demonstrating the contemporary relevance of her thought as it diagnoses the present and looks toward change for a better future. This book will be of great interest to undergraduate and postgraduate students looking to engage with the political content of Simone de Beauvoir's work and the timely application of her ideas. It is well-known that in recent years, alongside the familiar forms of modern ethical theory, such as consequentialism, deontology, and rights theory, there has been a resurgence of interest in what goes by the name of “virtue ethics” — forms of ethical theory which give a prominent status to the virtues, and to the idea that an agent has a “final end” which the virtues enable her to achieve. With this has come an increase of theoretical interest in ancient ethical (...) theories, particularly Aristotle's, an interest which has made a marked difference in the way ethics is pursued in the Anglo-Saxon and European intellectual worlds. In this essay, I shall not be discussing modern virtue ethics, which is notably protean in form and difficult to pin down. I shall be focusing on ancient eudaimonistic ethical theories, for in their case we can achieve a clearer discussion of the problem I wish to discuss. (shrink)

3D FORMOTION, a unified cortical model of motion integration and segmentation, explains how brain mechanisms of form and motion processing interact to generate coherent percepts of object motion from spatially distributed and ambiguous visual information. The same cortical circuits reproduce motion-induced distortion of position maps, including both flash-lag and flash-drag effects.

In the Stoics we find a combination of two perspectives which are commonly thought to conflict: the embedded perspective from within one's social context, and the universal perspective of the member of the moral community of rational beings. I argue that the Stoics do have a unified theory, one which avoids problems that trouble some modern theories which try to unite these perspectives.

Recently, political models which employ lottery-selection instead of ballot voting have been proposed. Proponents argue that such lottocratic models can improve the representation of the population and reduce undemocratic influences. In this paper, I argue that these proposals also satisfy the egalitarian requirement of democracy. I claim that having an equal chance to be selected by lot is equally egalitarian as having an equally weighed vote for two reasons: first, having a chance to be selected by lot satisfies the requirement (...) for political justice better than electoral democracy, and second, it provides citizens with equal political influence and not merely equal impact. Disputes have arisen about the nature of the truth-conferrers and about the status and the nature of the individual's own authority about the state he is in. A dissenting position in philosophy of mind would have to be handled carefully.
